1 – Interpretation and Definitions

1.1 – Interpretation

Words with their initial letters capitalized have specific meanings as defined below. These definitions apply equally whether they appear in the singular or plural.

1.2 – Definitions

For the purposes of these Terms of Service: • Account means a unique account created for You to access Our Service or parts of Our Service. • Affiliate means an entity that controls, is controlled by, or is under common control with a party, where “control” means ownership of 50% or more of the shares or equity interest entitled to vote. • Application means the software program provided by Rabbit Match, downloaded by You on any electronic device, named “Rabbit Match.” • Buyer refers to any user of the Service who is searching for or inquiring about rabbits (or other Goods) listed by Sellers. • Company (also referred to as “the Company,” “We,” “Us,” or “Our”) refers to Rabbit Match, operating in the United States (the “Country”) and available at https://rabbitmatch.net. • Content refers to text, images, or other information that can be posted, uploaded, linked, or otherwise made available by You on the Service. • Country refers to the United States of America. • Device means any device that can access the Service, such as a computer, a cellphone, or a digital tablet. • Feedback means feedback, innovation, or suggestions sent by You regarding Our Service’s features, performance, or attributes. • Good refers to the items or services offered for sale, adoption, listing, or any other means of trade on the Service (primarily rabbits, in this context). • Operator (also referred to as “the Operator,” “We,” “Us,” or “Our”) refers to Rabbit Match, run by those operating the rabbitmatch.net domain. • Order means a request by You to acquire or adopt Goods (rabbits) on the Application or Website. • Seller refers to any user of the Service who creates a listing for rabbits or related Goods, making them available to Buyers/Adopters. • Service refers collectively to the Website and/or Application and all features of the Rabbit Match platform, including (but not limited to) rabbit listings, user messaging, subscription and membership systems, and educational content. • Terms of Service (also referred to as “Terms”) means this agreement which forms the entire agreement between You and Rabbit Match regarding Your use of the Service. • Third-party Social Media Service means any services or content provided by a third party that may be displayed or made available by Our Service. • Website refers to Rabbit Match, accessible via https://rabbitmatch.net. • You means the individual accessing or using the Service, or the company or other legal entity on whose behalf such individual is accessing the Service.

3 – Acknowledgment

These Terms govern Your use of Rabbit Match and set out rights and obligations for all users. By accessing or using the Service, You agree to be bound by these Terms. If You disagree with any part of these Terms, You must discontinue using the Service immediately.

Your use of Rabbit Match is also governed by Our Privacy Policy, which explains how We collect, safeguard, and use Your personal information. Please review it carefully before using Our Service.

By creating an Account or otherwise utilizing Rabbit Match, You represent that You are at least the age of majority in Your jurisdiction, and legally capable of entering into binding contracts. Rabbit Match does not permit users under the age of majority to use the Service.

4 – Governing Law

These Terms shall be governed by the laws of the United States of America, excluding its conflict of law rules. Any disputes arising hereunder shall be resolved in accordance with the laws of the Country.

4.1 – For EU Users

If You are a European Union (EU) user, You may benefit from any mandatory provisions of the law of the country in which You are habitually resident.

4.2 – U.S. Legal Compliance

You warrant that You are not located in a territory subject to U.S. government embargo or designated as a “terrorist supporting” country and that You are not listed on any U.S. government list of prohibited or restricted parties.

4.3 – Severability

If any provision of these Terms is held invalid or unenforceable, such provision will be revised to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will remain in full effect.

4.4 – Waiver

Failure to exercise a right or require performance of an obligation under these Terms does not affect the right to exercise such right or require such performance at any time thereafter. A waiver of one breach does not constitute a waiver of any subsequent breach.

5 – User Accounts

5.1 – Account Creation

To use certain features, You must create an Account by providing accurate, complete, and current information. If You supply false or incomplete details, We may suspend or terminate Your Account.

5.2 – Account Responsibility

You are responsible for safeguarding Your password and for all actions under Your password. If You suspect unauthorized use of Your Account, You must notify Us immediately. Rabbit Match assumes no liability for unauthorized use of Your Account.

5.3 – Identity Verification

We do not systematically perform background checks on users. While We may provide optional verification features, We do not guarantee user identity, character, or reliability. You agree to exercise caution and due diligence in interactions with other users.

5.4 – Account Termination

We may suspend or terminate Your Account at any time, without prior notice, if You violate these Terms or for other legitimate reasons. If You wish to terminate Your Account, You may discontinue using the Service or contact Us for assistance.

6 – Content

6.1 – User-Generated Content

Our Service allows You to post Content, such as listings, text, photos, and more. You are solely responsible for any Content You post. By submitting Content on Rabbit Match: 1. You represent that You own or have the necessary rights and permissions to post such Content. 2. You grant Rabbit Match a limited, worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, modify, publicly display, and otherwise exploit Your Content strictly for the operation, promotion, and improvement of the Service.

6.2 – Content Restrictions

You agree not to post Content that: • Is unlawful, defamatory, harassing, hateful, or otherwise objectionable. • Contains spam, malware, or unauthorized advertising. • Infringes on any intellectual property or privacy rights. • Violates any local, state, national, or international law.

Rabbit Match reserves the right, but not the obligation, to remove or restrict any Content that violates these Terms or is deemed inappropriate at Our sole discretion.

6.3 – No Responsibility for User Content

We do not endorse or guarantee the accuracy or reliability of Content posted by users. Your reliance on user-generated Content is at Your own risk. We do not undertake to verify or update listings or user submissions.

6.4 – Backup of Content

Although We routinely back up data, we make no guarantee that backups will be error-free or fully recoverable. You are responsible for maintaining independent copies of Your Content.

7 – Orders of Goods (Rabbit Adoptions)

7.1 – Platform Role: Listing & Connection Service

Rabbit Match acts solely as a platform where Sellers can list rabbits and Buyers can inquire or arrange adoptions. We are not a party to any transaction or adoption agreement between You and any other user. Any arrangement, discussion, or final agreement is strictly between Buyer and Seller.

7.2 – Payment & Financial Transactions • No Facilitation of Rabbit Fees: Rabbit Match does not process or handle payments for rabbit adoptions. If a Seller requests an adoption fee, that transaction is entirely between Buyer and Seller. • Platform Subscription Fee: Rabbit Match charges subscription fees to Sellers who wish to list or maintain listings. The subscription fee supports Our Service and does not guarantee an adoption outcome or verify a Seller’s claims. • Financial Disputes: All financial disputes (e.g., refunds, partial payments, deposits) are resolved solely between Buyer and Seller. Rabbit Match does not provide dispute resolution services or offer refunds for private transactions.

7.3 – Accuracy & Availability

We do not verify the accuracy of rabbit listings (e.g., age, breed, health). Each Seller is responsible for providing accurate information. We disclaim any liability for errors, omissions, or inaccuracies in any listing.

7.4 – Shipping & Transfer

If Buyer and Seller agree to ship or transport a rabbit: • Rabbit Match is not involved in any shipping arrangement. • You (Buyer/Seller) must research and comply with all laws, regulations, and best practices. • We disclaim liability for any damage, loss, or harm that may occur during shipping or transportation.

7.5 – Order Cancellation & Disputes • Cancellations: If Buyer or Seller cancels an adoption, the terms of any refund or compensation are strictly between them. • Dispute Resolution: Rabbit Match does not mediate or assume responsibility for disputes arising from listings, misrepresentations, payments, or post-adoption problems. By using the Service, You agree to release Rabbit Match from any dispute liability.

8 – Rabbit-Specific Disclaimers

8.1 – Animal Unpredictability

Rabbits are living creatures with unpredictable health and behavior. Rabbit Match makes no warranties about a rabbit’s temperament, compatibility, or future health. Adopting or rehoming a rabbit involves inherent risks, which You agree to assume.

8.2 – Health & Veterinary Care

Rabbit Match does not perform veterinary checks. Any health records or claims are provided by the Seller and not verified by Rabbit Match. We recommend that adopters seek their own veterinary evaluation. Rabbit Match is not responsible if a rabbit is later found to have undisclosed illnesses or conditions.

8.3 – Training & Approval Process

Rabbit Match may offer training resources or require certain steps (e.g., reading educational materials) for adopters to be considered “approved.” These steps are informational only and do not constitute certification or guarantee of suitability. • No Guarantee: “Approval” does not imply that Rabbit Match endorses the adopter’s reliability, character, or ability to care for a rabbit. • No Liability: We bear no liability for outcomes if a rabbit is adopted by an “approved” user who ultimately proves unsuitable.

8.4 – No Endorsement or Warranty

Rabbit Match does not endorse or warrant any Seller’s expertise, experience, or compliance with local laws. Sellers and Buyers must do their own due diligence. If a particular rabbit’s breed, lineage, or medical status is critical to You, verify it independently.

9 – User Safety & Personal Responsibility

9.1 – No Background Checks

Rabbit Match does not conduct in-depth background checks on users. You agree to exercise caution and take reasonable steps to protect Your safety. Examples: Arrange meet-ups in public places, bring a friend, verify the identity of the other party.

9.2 – Potential Risks

Any offline meeting or in-person transaction carries potential risks, including but not limited to personal injury, fraud, or damage to property. You assume full responsibility for such risks and agree that Rabbit Match is not liable for any harm resulting from user interactions.

9.3 – Indemnity for Misuse

If Your actions on Rabbit Match cause harm, liability, or legal claims (for instance, if You misrepresent a rabbit’s condition or engage in fraudulent activity), You agree to indemnify and hold Rabbit Match harmless from any costs or damages arising from such claims.

10 – Disclaimer of Warranties and Limitation of Liability

10.1 – “AS IS” and “AS AVAILABLE”

Rabbit Match provides the Service “as is” and “as available”, without any warranties (express or implied), including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be error-free, uninterrupted, or compatible with Your Device.

10.2 – Limitation of Liability

To the fullest extent permitted by law: • No Liability for Damages: Rabbit Match is not liable for any indirect, incidental, consequential, special, or punitive damages (e.g., lost profits, data loss, emotional distress) related to use of or inability to use the Service, even if advised of such possibilities. • Cap on Damages: If Rabbit Match is found liable despite these Terms, Our maximum liability to You shall not exceed the greater of: 1. the total amount of subscription fees You paid to Rabbit Match in the six (6) months prior to the event giving rise to the liability, or 2. one hundred U.S. dollars (USD $100).

10.3 – Release of Claims

You release and waive any and all claims, demands, or liabilities against Rabbit Match arising out of disputes between users (including but not limited to injuries, misrepresentations, or breach of any agreement regarding rabbit adoptions).

10.4 – Indemnification

You agree to indemnify, defend, and hold harmless Rabbit Match, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to: 1. Your use or misuse of the Service. 2. Your violation of these Terms. 3. Any breach of representations or warranties You make to other users. 4. Any Content You post or submit, including claims that it infringes or violates any third-party rights.

11 – Third-Party Links & Services

The Service may contain links to third-party websites or services that are not owned or controlled by Rabbit Match. We have no control over such sites and assume no responsibility for their content, privacy policies, or practices. Any reliance on third-party content is at Your own risk.

12 – Disputes Resolution

If You have a concern or dispute about the Service, contact contact@rabbitmatch.net first. We may try to address concerns informally. If informal resolution fails, You and Rabbit Match agree that any dispute shall be governed by these Terms and the laws of the United States.

13 – Intellectual Property of the Service

The Service, including its content (excluding user-generated Content), is and will remain the exclusive property of Rabbit Match and its licensors. The trademarks, logos, and trade dress of Rabbit Match may not be used without Our prior written consent.

14 – Your Feedback to Us

If You submit Feedback (e.g., suggestions, improvements), You assign all rights, title, and interest in that Feedback to Rabbit Match. If such assignment is ineffective, You grant Rabbit Match a non-exclusive, perpetual, irrevocable, royalty-free license to use and exploit the Feedback without restriction.

15 – Changes to These Terms

Rabbit Match reserves the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide notice (e.g., posting a prominent notice on the Service). By continuing to access or use the Service after these revisions take effect, You agree to be bound by the revised Terms. If You do not agree to the new Terms, You must stop using the Service immediately.

16 – Final Acknowledgments & Disclaimer 1. Disclaimer of Legal Advice: This Terms of Service document incorporates templates and disclaimers tailored to Rabbit Match’s needs, but it is not a substitute for legal counsel. You are encouraged to consult an attorney for advice regarding these Terms. 2. Entire Agreement: These Terms, together with any referenced policies (like Our Privacy Policy), constitute the entire agreement between You and Rabbit Match regarding the use of the Service. 3. No Agency or Partnership: Nothing in these Terms shall be interpreted as creating an agency, partnership, or joint venture relationship between Rabbit Match and any user. 4. Force Majeure: Rabbit Match shall not be liable for any failure to perform due to circumstances beyond Our reasonable control, such as natural disasters, internet outages, or government restrictions.

By using Rabbit Match, You confirm that You have read, understood, and agree to these Terms of Service. If You do not agree, do not use the Service.
